Work Process

The Client need to give us the following files:

∙script

∙an example of video Client want to make

∙logo ( vector format is preferred like .ai, .eps, .swf.)

∙Voice (if it is provided by the Client).

∙email id

∙skype id

∙contact number

Dakreative will send the Client updates on regular basis. And the Client is required to give feedback on each step. We work from Monday to Saturday from 9am to 5pm IST time except Indian national holidays. All transfers, conversation, updates, will not be received excluding this durations. National holiday list is given below.

Steps

1.Visualization – Dakreative will start working from the script provided by Client. This will be the guidance or basis for making slides and animation. The Client is required to fill up the visualisation form with feedback, comment, related pictures etc.

The Client can have 5 revisions in this step. No milestone is required to be transferred in this step.

2.Voice- the Client will be asked to choose the gender of the voice. We will send examples of voices to the Client which will be either male or female, as said by the client. After selecting the voice artist, the Client will be asked to give details about the genre, emotion, feeling required for the script.

The client can have no more than 1 revision in this step. Further revisions will be charged and will be notified to the Client in written. The Client is required to transfer the voice over cost in the very beginning of this step. This step requires maximum 3days depending on the availability of the artist. And revision turnaround time is also 3days maximum depending upon the availability of the artist. Please note that once the artist is hired the Client needs to work with that artist. If the Client needs to hire a different artist,

then extra charges for voice over will be charged. The Client will be notified in written about the additional cost.

3.Graphics- Dakreative will send Client the main characters first, to choose the style. The characters/visualisation will be similar to the style given by Client. After revisions, Dakreative will maintain the style and send you all the slides based on the visualization.

The client can have 4 revisions in this step. The Client has to pay the 50 % of the total milestone in this step to Dakreative, after satisfaction. This step requires 2-3 days, depending on the numbers of revisions we will go through.

4.Animation- Dakreative will send animated version of the video. Based upon the example of video given by client.

5.Render- After all the transfers of payment, Dakreative will deliver the without watermarked mp4 format in HD 1080p version file. Embedding or uploading in any broadcasting channel or website will not be the part of project.

The Client will download all related files needed within 10 days from the date of delivery. After that time period any loss, replacement of any kind of files will not be the responsibility of Dakreative.

Turnaround Time

Delivery turnaround time depends on the length and steps the Client needs to be done. And also depend on the number revisions needed to be done by Dakreative.

∙An average turnaround time frame for 1 min video is around 14 days unless there is urgency from the Client’s side. The 14 days time frame includes voice over recording time, animation and graphics time with no revisions.

∙For 1 min video without voice over (in case the Client provides it) the turnaround time is 3 days, which includes animation and graphics time with no revisions.

∙For any revision in graphics or animation the turnaround time is 1days.

∙For revisions in voice over, 1 to 3days, depending on the availability of the voice artist.

The Client will inform Dakreative at the beginning of the project, about their expected delivery time if different than above said.

Delays caused by natural calamities, talent unavailability due to illness or injury, or other events outside the reasonable control of Dakreative will not be the responsibility of

Dakreative and any Services provided in response to such events will be considered out of scope.

Please note that whenever and wherever talking about days of interaction with Client, working business days is to be considered.

Service Agreements

Pricing Methods

Payments can be made by PayPal or by direct bank transfer or by other freelancing websites or other methods to which both party agrees on. The payment of the first invoice amount indicates the Clients’ agreement to the amount of the total initial price.

In case of freelancing websites, the Client must keep the invoice amount in the respective freelancing website (stated as milestone or in escrow). After the respective website receives payment from the Client, we will start working when the first milestone is been placed in the website. The Client will release each milestone, when satisfied by Dakreative’ work.

For rest of the transfer methods (example- bank transfer, demand draft, cheque etc.) for each milestone, the Client must do the 30% payment in advance. Dakreative will start working after receiving the first payment.

Cancellation Policy

This Agreement may be terminated by either party if the other party commits a material breach of the terms hereof and fails to remedy the breach within 7 days of receiving written notification from the terminating party specifying the breach and requiring its remedy.

Dakreative may cancel this Agreement, effective upon 7 days’ written notice to the Client, if Dakreative has requested Client input or feedback needed for the Services and the Client has failed to provide the requested input or feedback.

Any notice required to be given under this Agreement must be given in writing by email or with a hard copy of the notice delivered by personal delivery or sent by a major overnight delivery service, for delivery in either case no later than the close of the second business day following the email notice. Notices will be deemed given on the first business day after the email was sent.

In cancellation process from either party, the 25% of the total amount of working invoice part has to be paid by the Client to Dakreative.

If the Client failed to give input or feedback within 7 working days, Dakreative will hold the right to terminate the project with the right to receive full payment agreed with the Client.

Final Product

Dakreative will showcase each updated work outputs using Dakreative water marks. The without watermark Output will be sent to Client after full payment. That is at the end of the project.

The Client will download their required videos or raw files (if required), within 10 business days, from the day of delivery; using Dropbox, Google Drive, We Transfer or relevant transferring mediums. Any loss of working files, related property will not be related to Dakreative.

Dakreative will send you files in HD resolution of videos in mp4 format 1280px x 720px size. Unless other formats is requested from client. After the day of delivery, the client can ask for more formats, within 10 days. Past that, the new deliverables will cost 20usd per size or format.

Copyrights

Dakreative assigns to the Client all right, title and interests to all of its copyrights in the video produced to the Services, effective upon payment by the Client of the final invoice (and any other outstanding invoices). Dakreative makes no ownership claim with respect to any copyrighted materials, trademarks, trade secrets or other intellectual property supplied by the Client for purposes of the Services.

The Client grants Dakreative (and its successors, assigns and affiliates) a non-exclusive, limited license to use any videos produced by Dakreative, or portion thereof for demonstration, sample and marketing purposes, including without limitation the right to display such material on Dakreative’ website. Dakreative may also include client’s company name and trademark or service mark for marketing purpose. Dakreative will not present any such material in a manner derogatory to the Client, if it has been asked by Client, under section “Confidentiality”.

The Client will hold harmless, protect, indemnify and defend Dakreative, its subcontractors, officers, directors, owners, employees, agents, representatives, and affiliates from any and all liability, damages, costs, or expenses (including attorney’s fees and court costs), including any claim or suit, threatened or actual, arising from the use of such elements by Dakreative.

Confidentiality

The Client will provide any and all information and decisions required for the successful outcome of the project and will designate to us in writing of any portion of the project which is confidential, in the very beginning of the project. Dakreative agrees to treat such designated information with the same degree of confidentiality as provided by client, with no less than a reasonable degree of care.

*Dakreative avoid any verbal communication through phone or skype or similar mediums. Client is requested to share thoughts, communication, and any discussion through email, any freelancing websites, skype or by similar means in written format. It is for necessity for both of the parties, to keep records in written form, so as to use as a proof for the conversation, agreements, feedback and everything between both parties.
